New York takes the parents’ obligation to support their children very seriously. The law provides that both parents must share in the financial responsibility of raising their children until the children reach the age of 21, or are sooner emancipated.
In general terms, child support is based on the incomes of both parents and which parent has actual physical custody of the children. State guidelines the amount of ‘basic’ or weekly child support that a court will order a non-custodial parent to pay the custodial parent, based on a percentage of income. The amount of the percentage (i.e. 17%, 25%, 29%, etc.) varies with the number of children to be supported
