Do I Have to Prove Grounds for Divorce?
In New York state, there are two paths to dissolving a marriage:
- "No fault" divorce — After living apart for one year under a formal marital separation agreement (MSA), you can file for divorce. You do not have to accuse your spouse of anything. Because the major issues (assets, custody, support) have already been worked out in the MSA, the process is fairly quick and painless after the 12-month period.
- Fault-based divorce — If you don't want to wait for a year, you can file for divorce based on one of four grounds: cruel and inhuman treatment, adultery, abandonment or constructive abandonment (withholding sexual relations).
One spouse must allege divorce grounds against the other. When both parties want the divorce, this is really just a formality. The "victim" does not get any special treatment in alimony, division of property or child custody. . Grounds for divorce are rarely contested, unless one spouse is resisting divorce because he or she has a distinct financial benefit from staying married.
